GENERAL CONDITIONS OF SALE
Veracova’s website (the "Site") is an e-commerce website, which can be accessed via the Internet network at the following address www.veracova.com. It is edited by COVESSENCE ("Us"), a simplified joint-stock company with a capital of 200,000 euros, registered in Paris under the number 805 265 444 headquartered in 171, avenue du Maine 75014 Paris, France. The Site enables COVESSENCE to sell cosmetics products under the "Veracova" brand.
The Site is hosted by

These
General Conditions of Sale
(the « Conditions of Sale ») are
applied to any Internet user who
places an order on our website.
Their aim is to establish the
conditions underwhich the sale
agreement between COVESSENCE and
each of its clients (the "Clients")
is concluded.
Any order
requires consultation and express
acceptance to these
Conditions of Sale
without however such acceptance
being subject to the Client’s
handwritten signature.
The Client may save or print these Conditions of Sales provided however that the Client does not modify them.
We reserve the right to modify at any time and without prior notice the Conditions of Sale provided that such changes will not apply to reservations and orders previously accepted and confirmed by the Client. If the Client does not wish to accept the modified Conditions of Sale, he will have to stop placing orders on our Site. Otherwise, the Client shall be deemed to have accepted the Conditions of Sale as adapted or modified.
Products offered for sale on the
Site are offered without
geographical limitation and subject
to stocks availability. Special
offers are only valid during the
period of validity of each offer and
subject to availability of the
products involved.
In the
case of unavailability of one or
more products after placing an
order, you will be notified by
e-mail. Your order amount will be
recalculated and you will be debited
of the new amount. If your order is
entirely unavailable, you will be
notified by e-mail and not be
debited. In accordance to the
article L. 111-1 of the Code of
Consumption, the Client may, prior
to his order, take note on the Site,
of the essential characteristics of
the products he wishes to order.
COVESSENCE is not to be held
responsible for eventual errors
found in their specifications, as
the photographs, graphics and
samples are solely intended for
illustrative purposes.
The
prices on the Site may be displayed
in different currencies, either
based on the default currency for
the store visited or as chosen by
the Client, all taxes are included
and may vary during any given year.
The products ordered will be
invoiced according to the price in
use at the moment of the order
validation. They don’t include the
shipping fees which are charged in
addition to the total amount of the
order. Shipping fees shall be
indicated before the order
validation by the Client.
Products price may be modified at anytime by Veracova.
Special offers and special prices offered on the Site only apply to the products sold online and not to the products sold in retail stores (online or offline), and vice versa. All our offers follow the current Conditions of Sale at the time of the order.
To place an order, the Client must
have legal capacity to contract,
which means to have the legal
majority and not to be under
supervision or trusteeship. Prior to
any first order, the Client must
register on the Site and will then
indicate his gender, name, first
name and e-mail. An account with a
username and a password (chosen by
the Client) will then be assigned to
him.
Prior to any order
session, the Client must login using
his username and password. The
Client may then, during a session,
choose the products he wishes to
order on the Site.
Any order is worth express and irrevocable acceptance of the prices, descriptions, delivery terms of the products on the Site.
The Client declares to have acknowledged and accepted the present General Conditions of Sale before placing his order. After placing and validating his order, the Client shall verify the details and total price of this order which he can confirm or modify if a mistake has been made.
Once the order has been confirmed,
it is considered as validated, and
the Client is committed to the
order. An order number is then
assigned to him which he must
retain.
At this stage, the
products are already being prepared
for the shipping, it is thus
impossible to cancel or modify the
order. The Client will have to
exercise his right of withdrawal
once his order received. The Client
has the obligation to pay the amount
displayed after the check-out
process as well as the shipping fees
as defined in the
Conditions of Sale
in « Delivery » section.
Once the order is validated, the
Client receives a confirmation
e-mail with the details of his
order, to the address he indicated.
The exact amount invoiced and the
conditions of delivery will be
specified in this e-mail.
The
Client acknowledges that this
e-mail, which information results
from the validation of his order, be
considered proof of the nature of
the agreement and its date.The order
will be validated by Veracova once
the payment is fully completed.
Veracova reserves the right to
cancel or suspend any order placed
on the Site if it estimates a Client
has violated one of the terms of our
Conditions of Sale
or if there is a dispute concerning
payment of a previous order.
COVESSENCE also reserves the right
to forbid the access to the Site to
people who are believed to have
violated one of the terms of our
Conditions of Sale.
All the orders can only be paid in
the currencies offered on the store
being visited. But your bank may
debit your account in its main
currency if the one chosen on our
Site is not available on your bank
account.
The amount to pay is
the total amount of the ordered
products, all taxes included to
which the shipping fees are added as
defined in the Conditions of Sale in
the "Delivery Terms" section.
To settle the
order, the Client has the choice
between the following payment
options : bank cards and Paypal. The
bank cards accepted on the Site are
: Carte Bleue, Visa, Master Card,
Maestro, American Express, Diners
Club International, Discover,
JCB...
The Client guarantees to
COVESSENCE that he possesses all
required authorizations to use the
form of payment of his choice,
during the processing of the order
form.
We reserve the right to
suspend or cancel any order and/or
delivery, whatever its nature and
level of execution in case of
default in payment or in case of
incident of payment. Charges on any
unpaid amount will be incurred at
the legal interest rate plus 5
percent following a period of ten
days from the invoice date.
In order to fight against fraudulent
activities over the Internet,
information pertaining to your order
might be communicated to third
parties for verification.
To
ensure security for credit card
payment, the Client shall be asked
to send the visual cryptogram (CVV)
on the card to 2Checkout Payment
Gateway. Our site is equipped with a
secure online payment. Your bank
card number and its expiration date,
are immediately encrypted under
protocol SSL (Secure Socket Layer)
which ensures the security of the
information.
COVESSENCE has no
access to this information and does
not keep them in its servers. As a
result, the Client shall input his
bank information for each order.
The products are delivered at the
address indicated by the Client on
the order form, according to the
delivery option of his choice.

The delivery will be done within a period of 2 to 11 days from the reception of the order form and according to the delivery country and delivery option. Any specifics useful to the shipment of the package must be communicated to us by the Client.
Over the Christmas period, (from November 15th to December 31st) COVESSENCE reserves the right to extend the delivery period according to the inflow of orders it gets. You will be notified by e-mail about the estimated delivery date. COVESSENCE is not to be held responsible for any delay in the transportation and for any reason whatsoever. However and according to the terms of the article L121-20-3 of the Code of Consumption, failure to deliver within a period of 30 days from the day the Client placed his order, gives him the right to cancel his order. The amount he paid will be immediately refunded, with no other compensation taken into consideration.
(i) Colissimo Delivery
The parcel containing all the
products ordered and paid by the
Client are placed in the mailbox at
the Delivery Address indicated by
the Client. In case the mailbox
would be too small for the parcel,
the parcel shall be delivered to the
Client’s home and given either to
the Client, to the parcel’s
addressee or to another person,
notably someone living with him,
specially assigned, who has been
granted proxy or any identified
third party person. When the parcel
could not be delivered for the
reasons stated previously
(insufficient size of the mailbox
and/or absence of the addressee),
the Client or order’s addressee
receives a notice authorizing him to
collect his goods at his local post
office, during the following 14
days.
After this time, the
parcel is returned to the sender. In
that case, the Client shall be
refunded, with the delivery costs
deducted, using any means, of
COVESSENCE’s choice. No protest
related to the order delivery is
possible once the parcel’s status is
shown as delivered, La Poste’s
computer system (flashing) will be
considered as proof.
(ii) Mondial Relay delivery at Relay Points
The parcel containing the products ordered and paid by the Client is delivered at the Relay Point chosen by the Client during his order. He receives an email authorizing him to collect his goods at the Relay Point, during the following 15 days. Picking up the parcel at the Relay Point is possible on presentation of the authorization email and the Clients’s ID.
After this time, the parcel is returned to sender. In that case, the Client shall be refunded, with the delivery costs deducted, using any means, of COVESSENCE’s choice. No protest related to the order delivery is possible once the parcel’s status is shown as delivered, Mondial Relay’s registry will be considered as proof.
(iii) Mondial Relay delivery at home in Europe
The parcel containing the products ordered and paid by the Client is given with signature to the Client at the delivery address indicated by the Client. In case the Client is unavailable, the parcel will be given to the parcel’s addressee or to another person, notably someone living with him, specially assigned, who has been granted proxy or any identified third party person. In case of absence, a second attempt of delivery will be made. No protest related to the order delivery is possible once the parcel’s status is shown as delivered, Mondial Relay’s registry will be considered as proof.

These Conditions of Sale and the
order summary sent to the customer
represent the entirety of the
existing contractual relations
between both parties.
In case
of discrepancy between those
documents, the terms and conditions
shall prevail.
These Conditions of Sale refer to the French law. Any dispute relating to the interpretation, execution or breach of the contract between COVESSENCE and the Client, even in case of plurality of defendants, if no amicable agreement is found, will be under the exclusive jurisdiction of the Paris Courts.
